Terms of Service

1. Agreement to Terms

By accessing or using Tuberalytics ("Service"), operated by Knight Digital Partners ("Company", "we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Tuberalytics is a YouTube niche research and Skool revenue intelligence platform. The Service provides tools for analyzing YouTube channels, discovering content niches, detecting video outliers, tracking competitor activity, and estimating Skool community revenue.

3. Account Registration

To access the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Systematically scrape, extract, or download data from the Service for purposes of building a competing product
• Use automated tools, bots, or scripts to access the Service beyond the provided API (if applicable)
• Reverse engineer, decompile, or disassemble any part of the Service
• Attempt to gain unauthorized access to the Service or its related systems
• Share your account credentials with third parties or allow multiple users to access a single account
• Use the Service in any way that could damage, disable, or impair the Service

5. Subscription Plans and Payment

Tuberalytics offers paid subscription plans with varying features and usage limits. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis (monthly or annually)
• Prices are in US dollars and may be subject to applicable taxes
• You may upgrade, downgrade, or cancel your subscription at any time through your account settings
• Downgrades take effect at the end of the current billing period

6. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

• Your subscription remains active until the end of your current billing period
• You retain full access to the Service until your subscription expires
• No partial refunds are provided for unused portions of a billing period

Refunds apply to your initial purchase only. Recurring subscription charges are non-refundable.

• Within 48 hours of purchase: Full refund, no questions asked. Contact us via the support page
• 3–15 days after purchase: 50% refund available upon request through our support page
• After 15 days: No refunds are issued

7. Data and Content

The Service aggregates publicly available data from YouTube and other public sources. We do not claim ownership of YouTube content or channel data. All YouTube data is subject to YouTube's Terms of Service.

You retain ownership of any content you create within the Service, including channel lists, research notes, and custom configurations.

8. Intellectual Property

The Service, including its design, code, algorithms, features, and documentation, is owned by Knight Digital Partners and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your active subscription.

9. AI-Generated Content

The Service uses artificial intelligence (powered by third-party providers including Anthropic Claude, OpenAI, and Google Gemini) to generate channel analyses, keyword suggestions, and content insights. AI-generated content is provided as-is and should be treated as suggestions rather than guarantees. We do not warrant the accuracy, completeness, or reliability of AI-generated outputs.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the six months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or use the Service in a manner that harms other users or the Service itself. We will make reasonable efforts to notify you before termination, except in cases of egregious violations.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law provisions.
